We take the protection of your personal data very seriously. In the following document, we explain what personal data we process, why we process it, for how long, and what your rights are.
About Us / Who is the Data Controller?
The data controller is the company GUMOTEX Coating, s.r.o., with its registered office in Břeclav, Mládežnická 3062/3a, Postal Code 690 02, The Czech Republic, Company ID: 074 17 659, reg. in the Commercial Register maintained by the Regional Court in Brno, Section C, File No. 108070 (hereinafter also referred to as the “Controller”).

When and where do we process your personal data, and what kind of data is it?
We process your personal data primarily in the Czech Republic, specifically in connection with your registration, the registration of products to obtain an extended warranty, orders / the conclusion of a contract, the operation of the website, and in the event of subscribing to commercial communications / newsletter in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter also referred to as the “Regulation”).
As a general rule, we do not transfer personal data outside the EU/EEA, except to the extent necessary to the carrier responsible for delivering products to you, or for the purpose of customs clearance and fulfilling other similar obligations, if the delivery address is outside the EU/EEA. However, in connection with the use of certain service providers (e.g., analytics and marketing tools), personal data may be transferred outside the EU/EEA. In such cases, we ensure appropriate safeguards for the transfer (e.g., transfer based on an adequacy decision or standard contractual clauses).
Considering your registration we process the following personal data:
a) Email address;
b) Phone number;
c) Name and Surname;
d) Billing and shipping address.
We process this personal data for the purpose of creating a user account. Such processing is permitted under Article 6(1)(b) and (f) of the Regulation. You may cancel your registration at any time.
We use the personal data listed under (a), i.e., your email address, to send you marketing communications only if you select the option to receive updates via email on the registration form. You can unsubscribe from these marketing communications at any time by clicking the unsubscribe link in the footer of the email.
Considering the registration of products to obtain an extended warranty we process the following personal data:
a) Email address;
b) Name and surname;
c) Contact address;
d) Information about registered products;
e) Information about the seller of registered products;
f) Sex;
g) Age;
h) Answers to any questions we may ask.
We process the personal data listed under (a) through (e) for the purpose of providing an extended warranty (your contact information, product information, and information for the purpose of verifying your purchase). Such processing is permitted under Article 6(1)(b) and (f) of the Regulation.
We process the personal data listed under (f), (g), and (h) only when you provide them and if you give your consent by checking the appropriate box on the registration form (consent to the processing of statistical data). This personal data is used for our statistical purposes. The processing of personal data listed under points (f) and (g) occurs automatically and only once after the registration form is submitted, at which point it is converted into anonymous statistical data. You may revoke your consent to the processing of personal data listed under point (h) at any time by sending a request to the Contact Email Address.
We use the personal data listed under (a), i.e., your email address, to send you marketing communications only if you select the option to receive updates via email on the registration form. You can unsubscribe from these marketing communications at any time by clicking the unsubscribe link in the footer of the email.
Considering placing an order / the conclusion of a contract we process the same personal data that you provided during registration, as well as information about the products you ordered, i.e.:
a) Email address;
b) Phone number;
c) Name and surname;
d) Billing and shipping address;
e) Information about the ordered products;
f) Purchase information.
We process this personal data for the purpose of fulfilling your order and performing the contract. Such processing is permitted under Article 6(1)(b) and (f) of the Regulation.
We use the personal data listed under (a), i.e., your email address, to send you marketing communications only if you select the option to receive updates via email on the registration form. You can unsubscribe from these marketing communications at any time by clicking the unsubscribe link in the footer of the email.
When operating the website – i.e., when you visit the website – we process technical data (e.g., IP address, access time, browser/device type, language settings) for the purposes of ensuring security, website operation, preventing misuse, and optimizing services. The legal basis for this is our legitimate interest. We retain this data for as long as strictly necessary (typically ranging from days to months, depending on the type of log and the need to resolve incidents).
If you subscribe to commercial communications / newsletter, we process this personal data:
a) Email address.
We process this personal data for the purpose of sending marketing communications based on your consent. Such processing is permitted under Article 6(1)(a) of the Regulation. You can unsubscribe from marketing communications at any time by clicking the unsubscribe link in the footer of the email.
How long will we process your personal data?
We will process the personal data you provide in connection with your registration for the duration of your registration.
We will process the personal data provided in connection with the registration of products to obtain an extended warranty for the duration of the extended warranty and for a period of four years following its expiration.
We will process the personal data provided in connection with an order / the conclusion of a contract for the duration of any warranty / liability for defects and, after its expiration, for a period of four years thereafter.
We will process the personal data provided in connection with subscribing to commercial communications / newsletter for as long as your consent to receive commercial communications remains in effect.
If judicial, administrative, or other proceedings are initiated and continue in which our rights or obligations in relation to you are being addressed, the period for processing personal data for the relevant purpose will not end before the end of such proceedings
We may process certain personal data for a longer period of time if required to do so by law. We retain documents and data related to accounting and tax obligations for the period specified by law (e.g., tax documents under the VAT Act are retained for 10 years from the end of the tax period in which the transaction took place; accounting records under the Accounting Act are retained for the applicable statutory period).
Who else may have access to your personal data?
The controller works with other entities (processors) that may have access to your personal data.
This processor may also have access to your personal data:
a) The Shopify platform, Shopify, Inc. (including the payment gateway and hosting)

Some recipients may act as independent controllers (typically carriers and payment service providers)—in such cases, they process data in accordance with their own privacy policies.
What are your rights?
Please note that, in accordance with the Regulation and applicable data protection laws, you have the right, in particular, to:
- request information from us about what personal data we process, and, if necessary, request a copy of that personal data;
- request an explanation from us regarding the processing of personal data;
- request access to this information from us and have it updated or corrected;
- request that we restrict the processing or erase this personal data – we will comply with your request unless there are legal grounds for further processing (e.g., performance of a contract, legal archiving obligations) or our legitimate interests;
- the right to data portability under the conditions set forth in Article 20 of the Regulation;
- the right to object at any time to processing based on our legitimate interest – if we process personal data for direct marketing purposes, we will no longer process it for that purpose once you have objected;
- If you have any doubts regarding compliance with obligations related to the processing of personal data, please contact us (file an objection) or contact the Office for Personal Data Protection, or, if necessary, a court.
Any other required information?
Providing the information requested for registration or an order is necessary for registration or for the conclusion and performance of a contract. Failure to provide this information may result in us being unable to complete your registration or process your order. You are not required to provide information marked as optional (e.g., statistical data when registering products).
If we process your personal data based on your consent, you may withdraw your consent at any time using the same method by which it was given (typically through account settings, an unsubscribe link in an email, or by sending a request to our Contact Email Address). Withdrawing your consent does not affect the lawfulness of the processing that took place prior to the withdrawal.
You have the right to file a complaint with the Office for Personal Data Protection (www.uoou.cz) if you believe that the processing of personal data violates the law.
We do not engage in automated individual decision-making within the meaning of Article 22 of the Regulation.
